Background Information:

Jack’s roadhouse has been in operation for decades. San Marcos records indicate a Conditional Use Permit issued to Jack’s Roadhouse in 1996 with no expiration date. In March 2018, the ownership of the business changed to Hallucivision who is still the current owner.

 

In August 2018, the Planning and Zoning Commission approved a Conditional Use Permit allowing the sale and on-premise consumption of mixed beverages valid for one (1) year. This permit expired on September 24, 2019.

Recommendation: 

Staff recommends approval of CUP-24-13 with the following conditions:

1.                     The permit shall be valid for one (1) year provided standards are met; and

2.                     No outdoor amplified live music shall be allowed on the property; and

3.                     The permit shall be posted in the same area and manner as the certificate of occupancy.
