Prior Council Action: The SMART Terminal Development Agreement was originally approved in 2019. Amendments to the Agreement were subsequently approved by City Council on January 17, 2023 (2023-20R) to add additional acreage which included land formerly subject to the Cotton Center MUD Development Agreement. At their April 18, 2023 meeting, Council voted to postpone the associated Zoning Change request ZC-23-01 until July 3.

Background Information:
Administrative amendments were recently made to the Development agreement. City Council has expressed a desire to consider initiating a review of the development agreement and authorizing staff to discuss options with the developer regarding possible amendments to the SMART Terminal development agreement. Staff is presenting these items to City Council for discussion.
