Background Information:
On February 9, 2023, two (2) bids were received in response to Invitation for Bids (IFB) 223-103 for a Spoilage Dump Site. The apparent low bidder was deemed non-responsive after requests via email for the legal permits necessary for dumping spoilage went unanswered. The purpose of this contract is to provide a spoilage dump site located in or adjacent to the San Marcos City Limits. The dump site will accommodate construction spoils such as base, dirt, concrete, and weathered asphalt by the Public Works and Utilities Departments for self-performed construction activities. Deliveries to the dump site will be made by City trucks.
Staff recommends award to the second lowest, most responsive, and responsible bidder, AE Cummings Co., Inc., San Marcos, Texas in the annual not-to-exceed amount of $48,000. The initial term of the contract will be for one (1) year for the annual amount of $48,000 with optional three (3) additional one (1) year terms: the total for four years is $192,000. Contract renewals may be awarded administratively in the form of an Authorization of Change in Service (ACIS).

Staff recommends approval of award of a contract to the lowest responsible bidder, AE Cummings Co., Inc., San Marcos, Texas as this bidder offered the most advantageous and lowest bid to the City in the annual not to exceed amount of $48,000.
