Consider approval of Resolution 2022-148R, approving a Restated and Amended Interlocal Cooperation Agreement with Texas State University relating to the Edwards Aquifer Habitat Conservation Plan to, among other things, provide the process for the equal sharing in the cost of the salary for the Habitat Conservation Project Plan Manager, identify conservation plan services to be provided by Texas State University at a cost of up to $266,000.00 per year and not to exceed $2,830,316.56 during the term, and extend the term of the agreement through March 31, 2028; authorizing the City Manager, or her designee, to execute this agreement on behalf of the city; and declaring an effective date.

Background Information:
The City council most recently approved amendments to this agreement in February of this year. This updated agreement remains substantially the same, but the contractual amount for Texas State’s services that has been reduced by $22,000 to reflect the closure of a federal grant for non-native removal. In addition, the agreement has an updated format, a modified signature block, and new terminology at the end of Section 1 and a. This agreement will supersede the previous agreements approved by Council.
With this ILA, Texas State University will fund the Meadows Center to implement four EAHCP measures: Texas Wild Rice Management, Key Recreation Management, Removal of Floating Plant Mats and Non-native Aquatic Plant Removal. The City will reimburse Texas State for these activities with money received through the EAHCP. In addition, Texas State will continue to pay for 50% of salary and benefits for the Plan Manager.
The City will reimburse Texas State an amount of $266,000, but not to exceed $2,830,316.56 through March 31, 2028.
