Prior Council Action: This ILA continues a longstanding partnership for San Marcos to provide sheltering services for the Animal Control operations in Hays County, City of Kyle, and City of Buda. In recent Council action, the FY19 ILAs for each entity were approved, and Council received a presentation on an implementation plan to achieve and sustain a 90% or higher Live Outcome Rate at the San Marcos Regional Animal Shelter.

Background Information:

The San Marcos Regional Animal Shelter is the sheltering facility for the Animal Control operations in Hays County, City of Kyle, and City of Buda. All government partners have demonstrated a commitment to continue the regional partnership and to strengthen it as we work together to achieve and sustain a 90% Live Outcome Rate.

 

On December 12, 2018, San Marcos City Council directed staff to formulate an implementation plan to reach a 90% Live Outcome Rate. The Pawsitive Outcomes Implementation Plan Committee was formed in January 2019 and by May 2019 came up with the draft plan. Parallel to the committee meetings, staff also convened meetings with the government partner representatives to discuss strategy, operations, funding, and implementation plan components. Most recently, each entity appointed 1-2 elected official to a budget and policy committee to further plan for policy/ordinance alignment and funding needed to achieve and sustain a 90% Live Outcome Rate.

 

Each partner entity’s budget share for FY20 is based on percentage of average annual intake: San Marcos 47%; Hays County 32%; Kyle 17%; and Buda 4%. In FY20, Hays County will pay $477,688 (up from $259,596 in FY19), City of Kyle will pay $256,547 (up from $141,881 in FY19), and City of Buda will pay $54,659 (up from $37,463 in FY19).

 

It was not possible to provide a redlined version of the previous agreements because going forward the parties will all sign off on one agreement rather than have separate agreements.  This is how several other entities prepare their agreement (Williamson County, for example).   Staff also believed one general agreement more clearly demonstrated the strong partnership among all of the entities. 

The general provisions of the interlocal agreement have not changed, but have been reformatted by Legal.  The recitals reflect recent policy shifts and cooperative actions of the parties.  The provisions that are new or have been revised are: 

1)                     The addition of a purpose section which tracks the Interlocal Cooperation Act requirements and expresses the intent of the parties to work closely together.

2)                     Under Section 2.1. Rights and Duties of the City of San Marcos, 2.1.5 clarifies that animals become the property of the City after the expiration of the hold period; 2.1.6 states that the City will vaccinate and microchip each animal upon intake; 2.1.8 provides that the City will share its shelter management software with the other entities.  Also, unlike previous agreements, Section 2 does not limit the times the other entities can drop off animals.

3)                     Section 2.3 states the parties will work together in updating their respective animal ordinances in an attempt to make them as compatible as possible.

4)                     Section 3.2 provides that the Parties provide the City notice of termination at least 90 days before the end of the fiscal year so the City and remaining Parties have sufficient time to readjust their budgets accordingly.

5)                     Section 4. Costs.  In previous agreements, the City changed a per animal cost for services.  The cost sharing methodology described in Section 4.1 is new. Section 4.2, the funding out clause, is required by the Interlocal Cooperation Act.  Section 4.3 is new and was included as a result of the large animal seizure case in Buda which required the Shelter to incur additional costs that had not been anticipated.
