Consider approval of Resolution 2019-49R, approving a Chapter 380 Economic Development Incentive and ETJ Development Agreement with Curby D. Ohnheiser, Diane M. Deringer, Carolyn J. Scurlock, Van Lee, LLC, Ohnheiser Properties and Texas Transportation Alliance, Ltd, a Texas Limited Partnership, that provides economic development incentives for the location of an Industrial Rail Park (commonly referred to as the SMART Terminal Project) located along Highway 80, waives certain development standards, prohibits certain land uses, and provides additional standards for water quality and flood prevention; authorizing the City Manager to execute said agreement on behalf of the city; and declaring an effective date.

Prior Council Action: City Council approved Resolution 2018-184R, approving a Chapter 380 economic development incentive agreement with Katerra, Inc., on October 16, 2018. Council approved Ordinance, No. 2019-01, on the first of two readings, annexing to the City the subject property, on January 15, 2019. Council approved Ordinance No. 2019-02, on the first of two readings, amending the zoning map to designate the subject property "HI" Heavy Industrial District, on January 15, 2019. Council held a Work Session regarding the Katerra development and the SMART Terminal project on January 29, 2019.
