Background Information:

The City Council previously approved an Interlocal Cooperation Agreement between the San Marcos Consolidated Independent School District and the City of San Marcos for Shared Data Connectivity, Resolution 2016-17R, for the primary purpose of allowing the San Marcos Police Department to access SMCISD video surveillance systems in situations considered to be urgent or life-threatening.  Section 3.3 on the attached agreement has been amended to extend the access authority to the San Marcos Fire Department (SMFD), and those specifically authorized by the bonafide Incident Commander during a scenario involving SMCISD.  The agreement also authorizes secure Virtual Circuits as defined in section 1.12.

 

On October 15, 2018 the San Marcos Consolidated Independent School District Board of Trustees approved the amended Interlocal Agreement.

 

Original language:

3.3                     The City and SMCISD agree to jointly maintain the shared connection only for approved activities outlined in this agreement.

1.                     SMPD access to SMCISD video surveillance

a.                     The San Marcos Police Department (SMPD) may only utilize the shared connection to access SMCISD video surveillance in situations that the SMPD believes to be urgent or life-threatening.

b.                     Non-urgent matters including, but not limited to enforcing the Student Code of Conduct do not justify remote video surveillance access. Such matters must be addressed by district administration and may be aided by School Resource Officers.

c.                     Routine video surveillance access by district administrators and School Resource Officers using on-premise resources and methods not facilitated by the shared connection are not governed by this agreement.

d.                     Live or pre-recorded video remains the sole property of SMCISD, and may not be stored, duplicated, or used for any purpose without the express written consent of SMCISD.

 

Added language:

1.12                     Virtual Circuit is a mechanism for a client to securely pass data from one point to another by traversing a host’s network, effectively creating an end-to-end connection that appears to function as a dedicated physical link between the client-managed source and destination of the data.  Although the virtual circuit is dependent on a tunnel maintained by the host network operator, the client will customarily leverage encryption and integrity protocols that safeguard and provide end-to-end integrity of the transported data.

 

Amended language:

3.3                     The City and SMCISD agree to jointly maintain the shared connection only for approved services outlined in this agreement.

1.                     Access to SMCISD video surveillance by emergency first responders

a.                     Eligible first responders are designated as the San Marcos Police Department (SMPD), the San Marcos Fire Department (SMFD), and those specifically authorized by the bonafide Incident Commander during a scenario involving SMCISD.

b.                     First responders may only access video surveillance in situations characterized as urgent or life-threatening, or during documented training and rehearsal exercises conducted specifically in preparation for such an event.

c.                     Non-urgent matters including monitoring or investigation of behavior or disruptive activity is not authorized by this agreement.  These matters must be addressed by district administration and may be aided by SMPD School Resource Officers. 

d.                     Routine video surveillance access by district administrators and School Resource Officers using on-premise resources and methods not facilitated by the shared connection are not governed by this agreement.

e.                     Live or pre-recorded video remains the sole property of SMCISD, and may not be stored, duplicated, or used for any purpose without the express written consent of SMCISD. 

2.                     Virtual Circuits: Either the City or SMCISD (acting as a client) may request a virtual circuit for network connectivity through the others network (host network).

a.                     Industry best-practices must be implemented by the client to ensure the data passed through the host network is encrypted.

b.                     The host must allow client review of device configuration settings relevant to the establishment of the virtual circuit and security of client data.

c.                     Any deliberate attempt by the host to decipher, alter, or intercept the client’s data will be considered a breach of this agreement.

d.                     Co-location of equipment is implied and authorized for the establishment or utilization of virtual circuits.  Operating guidelines for the treatment and access to co-located equipment will be negotiated between the City and SMCISD technical staff on a case-by-case basis.

3.                     Limited access will be provided to each parties’ technical staff for testing and maintaining the shared connection and approved services.

Recommendation: 

It is recommended the Council approve the amended Interlocal Agreement Between the City of San Marcos and San Marcos CISD for Shared Data Connectivity, and designate the City Manager to execute the agreement.
