BACKGROUND:
Chapter 242 of the Texas Local Government Code provides for a municipality and a county to enter into an agreement governing each entity's role in the regulation of subdivisions and the approval of related permits in the extraterritorial jurisdiction (ETJ) of the municipality. These agreements are commonly referred to as "1445" agreements based on the legislative bill number assigned to the original law.

The term of the previous Caldwell County agreement has expired.

Under the agreement, the City will generally approve subdivision plats and will enforce its development regulations. Certain County regulations, however, such as rules governing septic systems will apply. Similarly, the County's road standards will generally apply.

The agreement also sets forth procedures for the processing of applications and the manner in which the City and County will cooperate and communicate with each other regarding development in the ETJ.
