Background Information:
At the December 15th, 2020 regular meeting, City Council considered approval of Ordinance 2020-86 which amended the Kissing Tree reinvestment zone financing plan for the Kissing Tree TIRZ. At that time Council directed staff to work with the developers (Brookfield Residential) to amend the project's development agreement to include the following requirements:
* Use of the golf course by San Marcos High School at no fee or a reduced fee
* Use of the golf course by San Marcos residents at a reduced fee
* Public use of and access to the Kissing Tree clubhouse/amenity center
* Redirection of a percentage of the home closing fees to a community benefit fund

Staff met with the project representatives on January 15th, March 4th and March 24th and agreed to the following:
