CITY COUNCIL GOAL: Big Picture Infrastructure
BACKGROUND:
The City Council previously approved Ordinance No. 2013-18 and Ordinance No. 2014-13 approving Consent Agreements for the creation of LaSalle Municipal Utility Districts Numbers 1, 2, 3, 4 and 5 (MUD). These MUDs were subsequently created by the Texas Legislature.
Section 2.04 of the Consent Agreements discusses expiration of the City's consent for creation of the MUDs as follows: "The City's consent shall be deemed withdrawn and the District(s) shall be dissolved if: (a) The District has not held a confirmation election within two (2) years from the date of its creation by the legislature
"
The applicant is requesting an extension of the deadline to hold a confirmation election to four (4) years rather than two (2) years as stated in the consent agreements. Staff finds this amendment consistent with Chapter 70 of the City's Code of Ordinances and the state law authorizing the creation of the MUDs and recommends approval of the Ordinance authorizing an amendment to the Consent Agreements to extend the confirmation election two additional years to four (4) years of the date of the legislation.
