Background Information:
In Texas Health and Safety Code Title 10, Health and Safety of Animals Chapter 826, Titled Rabies there is a requirement in Section 826.017 that the commissioners court of each county and the governing body of each municipality designate an officer to act as the Local Rabies Control Authority.
The San Marcos City Animal Control Ordinance (section 6.003) recognizes that requirement and states that the Animal Services Manager shall act as the Local Rabies Control Authority for the purpose of enforcing animal health and control laws.
The Animal Services Manager position is currently vacant. This resolution fulfills the state law obligation to designate a Local Rabies Control Authority on a temporary basis until such time as the position designated in the local ordinance is filled.
