Background Information:

This license agreement request is to allow an existing sign to be located within a Public Utility Easement (PUE) along the IH 35 Frontage Road. The sign was constructed at its current location prior to 2008. The applicant would like to replace the sign cabinet on the existing pole.

 

Replacing the existing sign face does not require a permit; however, because the applicant is altering the structure of the sign cabinet a new sign permit is required, and staff must review under the current sign standards. Section 7.3.1.6.A.6 states, “New signs and signs being structurally altered shall maintain clearance from the public utility facilities, shall not substantially interfere with drainage and shall not be located in or above a utility or drainage easement...”.

 

The proposed license agreement would allow the sign to be structurally altered and for the sign to remain in the Public Utility Easement.
