Fiscal Note:
Prior Council Action: At their January 17th meeting Council voted to approve ZC-22-43 on first reading, with the request that the developer provide a buffer between the CD-4 and the adjacent residential development to the east in the ETJ (because the adjacent neighborhood is not zoned, Transitional Protective Yard requirements would not apply).

UPDATE: The developer has reduced the zoning boundary to provide a 9 ft Future Development "FD" buffer between the residential neighborhood and the CD-4 zoning. The FD zoning will also trigger the requirement for a Transitional Protective Yard per Section 7.2.2.2 of the Land Development Code which is the same protective yard standard that would normally be required adjacent a SF-6 (Single Family-6) zoning district.
