Background Information:
Judge Vincent Luizzi is retiring August 31, 2021 and does not desire to be re-appointed as associate municipal court judge. The court requires at least one associate (back-up) judge to act when the presiding judge is ill, attending mandatory training or on vacation.
The State Law regarding municipal court judges, Texas Government Code § 30.00006(d), requires that the term of office for municipal court judges be for a definite term of two or four years. Chapter 55 of the San Marcos City Code contains provisions governing the operation of the Municipal Court. Section 55.03 of the City Code provides that the presiding and associate judges be appointed for a term of two years.
