Background Information:
Per the Edwards Aquifer Habitat Conservation Plan and Incidental Take Permit with U.S. Fish and Wildlife Service, the City is required to designate a hazardous material transport route which is to be used by carriers to minimize the potential for spills entering the upper San Marcos River and negative impacts to endangered species and the aquatic ecosystem. As such, a hazardous material transport route has been proposed that generally follows FM110 which crosses the San Marcos River downstream of critical endangered species habitat.
The process for establishing a non-radioactive hazardous material route (NRHM) requires compliance with both federal and state regulations for NRHM routing and coordination with the Texas Department of Transportation (TXDOT). The process includes the following steps:
1. Initial contact with TXDOT and political subdivisions within a 25-mile radius of a proposed route (completed);
2. Route analysis and proposal report (attached);
3. Local public hearing;
4. Route proposal submission to TXDOT;
5. TXDOT public hearing and notice;
6. TXDOT coordination with other states;
7. TXDOT approval;
8. City Council designation of the NRHM route via ordinance or resolution;
9. Signage installation
