Background Information:
At the December 15th, 2020 regular meeting, City Council considered approval of Ordinance 2020-86 which amended the Kissing Tree reinvestment zone financing plan for the Kissing Tree TIRZ. At that time Council directed staff to work with the developers (Brookfield Residential) to amend the project’s development agreement to include the following requirements:
• Use of the golf course by San Marcos High School at no fee or a reduced fee
• Use of the golf course by San Marcos residents at a reduced fee
• Public use of and access to the Kissing Tree clubhouse/amenity center
• Redirection of a percentage of the home closing fees to a community benefit fund
Staff met with the project representatives on January 15th, March 4th and March 24th and agreed to the following:
• The home closing fees and associated community benefit fund do not need to be addressed any further at this time.
• Additional research and coordination between Brookfield Residential and San Marcos High School is required prior to amending the agreement to allow for prioritized or subsidized use of the golf course by San Marcos High School. Potential amendments to the agreement that Brookfield Residential would be amenable to would be based on the determined need. Both parties agreed that Brookfield should meet with the San Marcos High School Athletics Director or similar staff to determine current needs and provide documentation of the outcome of that meeting.
• Use of the golf course by San Marcos residents is currently offered at 10% off the non-resident rate. The San Marcos resident fee should be included as a percentage in order to eliminate the need for regular amendments to the agreement.
• Brookfield currently provides public access to the clubhouse and the development agreement and Planned Development District stipulate that the “proposed Club House restaurant and meeting/banquet halls shall be available for public use.”
• It is the intent of Brookfield to sell the golf course so any agreement entered into should only be valid until Brookfield no longer owns the golf course.
• The discussed requirements could be addressed in a separate agreement outside the development agreement. Brookfield will submit a first draft to staff for review and to put on a future agenda for Council consideration.
At this time Carma Paso Robles LLC has provided the attached draft agreement ensuring use of the golf course by San Marcos residents at a reduced fee and a letter from the San Marcos High School Golf Couch discussing the golf team’s practice facility needs.
