Background Information:

Michael Schroeder has provided an email indicating his intent to amend the approved Development Agreement for LaSalle, generally located north of the San Marcos City Limits between Yarrington Road, SH 21 and IH 35. (see attached email)

 

History:

In 2013 / 2014 a Council Committee negotiated Consent Agreements for the LaSalle Municipal Utility Districts (MUD) 1-5. The Consent Agreements were amended in 2015, 2016 & 2017 to adjust the timeline and clarify the metrics of progress.

 

These Consent Agreements required the applicant, Michael Schroeder, to enter into a Development Agreement to guide the development of the property. In October 2014 Resolution 2014-144 was approved by City Council and requires the property to conform with SmartCode Standards.

 

In 2017 the applicant held various meetings with Staff to discuss the progress for planning the development.

 

In 2018 Staff approved various applications (plat, site permit, WPP, etc.) which have allowed pre-development activities on the property, namely the excavation of certain areas for the lakes proposed in the approved concept plan.

 

Current Request:

At this time Mr. Schroeder would like to amend the development agreement to temporarily allow an industrial use, which is not currently allowed in the agreement. He has indicated that the temporary use will end as residential development nears the proposed site, or in approximately 7 years.

 

The proposed industrial use includes the installation of mobile equipment which will wash, screen, mix and stockpile the materials excavated from the lakes for future use in the development of the property (see attached memo & photo). Mr. Schroeder has already received the necessary permits from TCEQ to carry out the proposed activity and requires an amendment to the development agreement in order to proceed.

 

 

Council Committee:

The original Council Committee, appointed to negotiate this request, consisted of: Mayor Daniel Guerrero along with Council Members Lisa Prewitt and Shane Scott.
