Background Information:

The wider site was originally annexed and zoned to Commercial (CM) in 2022. There were the following restrictive covenants associated with the 2022 zoning ordinance:

•                     Truck stop/ warehouse prohibited.

•                     No hotel/ motel within 200 ft of western boundary.

The Business Park (BP) zoning district was added to the Land Development Code in October 2023. The intent of the addition was to provide a “steppingstone” commercial district between CM zoning, and the more intense Heavy Commercial (HC) zoning.

The applicant is proposing to construct a Veterans Affairs (VA) outpatient clinic, which is already permitted under the current zoning as a medical use. However, the requested zoning district “BP” has fewer site layout constraints than “CM” Commercial.  For example, under the existing CM zoning, parking may not be located in front of the building, and the principal building should be set back no more than 20 ft from the primary street and 15 ft from the secondary street. BP zoning does not have these restrictions.
