Background Information:

The City has existing electric and water utility infrastructure in the area of the easement and the maintenance of existing facilities and future alteration, installation and expansion of utility facilities to serve this area as part of the City’s integrated utility system is necessary for the continued provision of reliable and continuous services to residents, institutions and businesses. A public utility easement at this location is necessary to facilitate the provision of these public utility services.

Council met in executive session on August 2nd, 2022 to receive a presentation from and provide guidance to staff on the use of eminent domain to acquire a public utility easement, and then approved on September 20th, 2022 the use of the power of eminent power and authorized up to $100,000 funds to acquire the easement.

As a purchase price for the easement could not be agreed to, a Commissioners Hearing was set for January 9th, 2023.  Immediately prior to the hearing, the property owner agreed to grant the easement for $115,000.
