Background Information:
This Amendment Number 1 to the Interlocal Agreement (ILA) with Hays County updates the agreement to remove the obligation for the County to construct the water line (at the cost of the City) from their project.
The original ILA was for the installation of 6,200 feet of 16” water main that is required by the Water Master plan and overlaps the Old Bastrop Highway (CR 266) Project limits. The agreement allowed for the City’s waterline installation to be bid and constructed by Hays County.
Hays County completed their design for a road widening project along Old Bastrop Road from Rattler Road to Centerpoint but had to delay the project due to a funding shortage on their improvements. The City has not sent any construction funds to the County since the project never bid, so no refund is required.
The County is unsure when they will receive the additional construction funds so the City will construct the water line on their own. The City can’t delay the water line any longer due to its obligation to finalize the transfer of residents from the Crystall Clear Special Utility District water line to the City’s water as agreed in the 2014 Certificate of Convenience and Necessity (CCN) swap.
With the removal of the construction from the ILA, all obligations of the agreement are completed and the ILA can be terminated.
The City is anticipated to start construction on this water line in the summer of 2024 using City Crews.
