Background Information:
This CUP request is to allow a “flex space” Warehouse/ Office and Storage Use within the General Commercial Zoning District as required by Chapter 9 of the Land Development Code. Chapter 9 does not have any land development code requirements for Warehouse/ Office and Storage once approved by Conditional Use Permit. Within Chapter 5, Section 5.1.7.4, Warehouse use is required to install a “transitional protective yard in accordance with Section 7.2.2.3 must be established along all shared property lines, except for an adjacent warehouse and distribution use, heavy industrial use or waste-related service.” Due to the existing commercial/retail character of the area, staff recommends installation of the transitional protective yard as is described in Section 5.1.7.4.

On October 8th, 2024, the Commission voted to postpone the hearing until November 12, 2024 Commission date. Commissioner Spell requested additional information:
1. Possible addition of conditions to the conditional use permit: loading areas for semi-trucks, and restrictions for large vehicular traffic.
Staff does not recommend conditions related to vehicular traffic.
2. Additional information related to the Centerpoint Road Improvements.
Centerpoint Road is planned for a Hays County and City of San Marcos bond project (funding approved in the 2024 election) to construct grade separation over the Union Pacific Railroad, as well as widen Centerpoint to a four lane, divided road. Construction on the project is estimated to be at least 5 years out or more.
3. Whether the CCR would allow for the transitional protective yard screen as recommended by staff.
Staff’s recommended condition for a transitional protective yard is allowed.
4. The development’s size and the proposed use of the property along Centerpoint Road.
The applicant has not responded to the commission or staff inquiry at this time.

Staff recommends approval with the following condition:
1. A transitional protective yard in accordance with Section 7.2.2.3 must be established along all shared property lines, except for an adjacent warehouse and distribution use, heavy industrial use or waste-related service.
