Background Information:
This is a request for voluntary annexation submitted by Gene Eitel on behalf of Rattler Road Storage LLC for approximately 3.62 acres of land out of the Rebecca Brown Survey, Abstract No. 46, Hays County, generally located on Rattler Road between Old Bastrop Highway and Highway 123.
Wastewater service will be provided by the City of San Marcos and water service will be provided by Crystal Clear Special Utility District. The site is not located within the San Marcos Wastewater CCN, however the CCN boundary will be updated after annexation of the site. The developer will be responsible for extending water and wastewater facilities through the site as needed. Bluebonnet Electric will provide electric services for this development. The City of San Marcos will provide Police, Fire, and EMS services to the site.
Below is a proposed schedule for this annexation, which complies with the Texas Local Government Code requirements.

Council Committee, Board/Commission Action:
City Council approved a Development Agreement for this property at their regularly scheduled meeting on December 2, 2020. The Development Agreement stipulates that the property shall be annexed and zoned to the Light Industrial zoning district prior to the issuance of Certificates of Occupancy. The Development Agreement stipulates the below development standards which are in addition to requirements of the San Marcos Development Code:
• All uses prohibited except self-storage and office
• 50% of building façade must be constructed of stucco or other approved masonry
• A transitional protective yard shall be provided between the structures and rear of property, i.e., along the shared property line with San Marcos High School
• Consistency with submitted site plan, landscape plan, and renderings.

City Council also approved Resolution 2021-26R, approving an agreement with Rattler Road Storage LLC for the provision of services at their regularly scheduled meeting on February 2, 2021. A copy of the agreement for the provision of services is included in this packet for reference.
