Background Information:

The City of San Marcos and Texas State University wish to enter into an Interlocal Agreement under the authority of the Interlocal Cooperation Act, Chapter 791 of the Texas Government Code, as amended. The purpose of the Agreement is to provide a temporary back-up source of water for fire suppression to Texas State while the Texas State elevated storage tank is out of service for maintenance. This connection is temporary and will be available only while the storage tank is out of service for maintenance. Use of the temporary water connection will only be used in the event of a fire and only if the Texas State public water system cannot maintain pressure in its system. Texas State agrees to pay all costs incurred by it, and any reasonable costs incurred by the City.  The reimbursement of costs will be made after receiving a written explanation of the charges and a detailed invoice.  The City will contact Texas State prior to the costs being incurred to inform them of the work required by the City. Texas State will also reimburse the City for any costs associated with TCEQ filings. Texas State agrees to pay for any usage in accordance with the City’s prevailing commercial rates. The term of the agreement shall begin on the effective date as set forth in the Agreement and will continue until the earlier of when Texas State returns its elevated storage tank to service or 24 months.

Recommendation: 

Staff recommends approving Res 2026-XXR for an interlocal agreement between CoSM and Texas State University for a temporary water connection to provide backup service for fire suppression.
