Background Information:

In 2015, state annexation law changed under House Bill 1949, requiring that a municipality proposing to annex territory adjacent to a County road must annex the entire width of the road. In 2024, the City annexed six stretches of right-of-way to ensure consistency with the law. The purpose of this item is to annex an additional six stretches of right-of-way. Some of these locations serve to ensure consistency with state law by addressing right-of-way omitted from annexations after 2015; others serve to fill gaps and allow for continuous ownership and maintenance along a stretch of road. These locations are being annexed with the permission of Hays County.

 

The approximate 5.42 acres is located along the following roads:

1.                     Centerpoint Road adjacent to the annexation under Ordinance 1994-50

2.                     S. Old Bastrop Highway from the annexation under Ordinance 2024-49 to the annexation under Ordinance 2004-77

3.                     Clovis Barker Road adjacent to UMC Subdivision, from the annexation under Ordinance 2015-29 to the annexation under Ordinance 1998-71

4.                     Yarrington Road adjacent to the Whisper East annexation under Ordinance 2022-47

5.                     Transportation Way and ½ of Lembo Drive adjacent to the annexation under Ordinance 2022-33

6.                     Transportation Way adjacent to the annexation under Ordinance 2020-32

 

Zoning is not proposed with this annexation; Future Development “FD” is the default zoning district for any annexed property unless zoned otherwise. An annexation service plan is attached.
