Background Information:
The purpose of this item is to adopt an updated federally compliant Title VI Non-Discrimination Policy that prohibits discrimination based on Race, Color, or National Origin.
Title VI is a component of the Civil Rights Act of 1964. It protects individuals from discrimination based on race, color, or national origin in programs and activities that receive federal funding. The protections include:
- Equal access to public services
- Language access for Limited English Proficiency (LEP)
- Protection from discrimination
- Equitable distribution of resources
- Equal opportunities for community participation and engagement
The City receives State and Federal funding to support transit, transportation, and infrastructure projects. To stay in compliance with the Texas Department of Transportation (TxDOT) and the U.S. Department of Transportation (U.S. DOT), including the Federal Transit Administration (FTA) and Federal Highway Administration (FHWA), the City must maintain an up-to-date Title VI Non-Discrimination Policy.
This Non-Discrimination Policy outlines:
- Procedures for public participation
- Steps for filing and resolving perceived discrimination complaints
- A Language Access Plan (LEP)
- Compliance with TxDOT, FTA and FHWA regulatory requirements
City Council approved the current Title VI Non-Discrimination Policy on November 15, 2022, and is required to review and adopt an updated document every three years. In the 2025 version of the Title VI Non-Discrimination Policy staff has updated language to be in compliance with TxDOT regulations. Major changes include an update to the complaint process to include FHWA procedures and references to the FHWA within the document.
The City of San Marcos received a non-compliance notification from the Texas Department of Transportation (TxDOT) related to Federal Highway Administration requirements. This notification began a process to update the Title VI Non-Discrimination Policy. To meet compliance standards, revisions were made to include:
- References for the Federal Highway Administration (FHWA)
- Designation of a Title VI Coordinator on the City’s website (sanmarcostx.gov/TitleVI)
- A defined complaint process specific to FHWA-funded projects
City Council previously adopted the current policy on November 15, 2022 (Resolution 2022-252R). Per regulatory requirements, the policy must be updated and readopted every three years. The next submissions are due as follows:
- TxDOT: September 2025
- FTA: November 15, 2025
