BACKGROUND:  In September 2014, the Annexation/Extraterritorial Jurisdiction (ETJ) Management Strategy was adopted by City Council. Every annexation and ETJ decision should be policy driven and evaluated in terms of how it fits with the annexation-related goals and policies of the comprehensive plan and with this strategy.

 

The Annexation/ETJ Review Team, comprised of multiple City departments, met on April 1, 2015 to finalize potential areas for annexation to bring forward for direction from City Council. After reviewing the Rolling Annexation Candidate List as laid out in the annexation strategy, a map of the draft candidate areas was created along with a list of property owners. A draft schedule of annexation has been included should Council decide to move forward with annexation of the areas shown on the map. These items are included as attachments.

 

64 properties totaling 1,166.46 acres or 1.82 square miles were identified for possible annexation. The current city limits of San Marcos consist of 32.29 square miles.  Seven (7) properties identified requested Out of City Utility Connections and/or Extensions (OCUs), eight (8) properties are owned by the City of San Marcos and nine (9) properties have agriculture exemptions. The remaining 40 properties were identified as areas bounded on two sides by the City Limits (e.g. infill). It is important to note that OCU requests include a signed consent to annex from the property owner. Also, per the Texas Local Government Code, properties with agriculture exemptions must be offered development agreements that would retain their ETJ status until such time development occurs on the property.

 

The property owners who requested the OCUs were sent a courtesy notice in anticipation of this Council agenda item. The attached project schedule also includes a public meeting date for all properties that have been identified as possible annexation candidates. All property owners of areas to be annexed will be notified of the public meeting following Council direction to staff. Staff is requesting direction from Council on moving forward with annexing the 64 identified properties.
