Prior Council Action: See “background information” below. The associated annexation request  was approved by Council on the first of two readings on Aug 19, 2025 however the second reading was postponed at the request of the applicant in order to align with the resubmittal of the associated zoning change (ZC-25-13) and Preferred Scenario Amendment (PSA-25-02). Per Section 3.11(d) of the Charter, all proposed ordinances requiring a public hearing or hearings shall be finally acted upon by the city council within 90 days of the most recent public hearing at which it was considered. If final action does not occur within the 90-day period following the public hearing, then another public hearing shall be held before final action on the ordinance.

Background Information:

This annexation request is approximately 65 acres and is part of a wider 199-acre site proposed for a data center. At the February 18, 2025 regular meeting, City Council voted to approve Resolution 2025-27R, which stated that the Public Hearing for AN-25-02 would be held on April 1, 2025. This was subsequently amended, at the request of the applicant, to May 6, then again on April 15 to July 1, and finally on July to August 19, 2025. The public hearing was held on August 19 and the annexation ordinance was approved on first of two readings. However, the associated Preferred Scenario Amendment (PSA-25-02) and Zoning Change (ZC-25-02) did not pass and so the annexation ordinance was not heard on second reading at the request of the applicant. The applicant has since resubmitted the Preferred Scenario Amendment (PSA-25-02) and Zoning Changes (ZC-25-13) and is requesting that the second reading of the postponed annexation ordinance be heard concurrently with the second readings of PSA-25-02 and ZC-25-13. An additional public hearing shall be required for the second reading of the ordinance on March 3, 2026.
