Background Information:
Approximately 86 of the property’s 170 acres is already within the City Limit and is zoned CC, GC, & MF-18. The existing entitled area is situated wholly within two preferred scenario designations - Low and Medium intensity zones. The remainder tract is approximately 84 acres and is situated mostly within a low intensity zone with a small portion situated within an Employment Area along IH35.
Council Committee, Board/Commission Action:
At their November 9, 2022 meeting, the Planning & Zoning Commission recommended denial of ZC-22-42 with a 9-0 vote. The following topics were discussed: (a) the buffer proposed by the applicant via restrictive covenant and how, in P&Z’s opinion, any size buffer is inadequate in the context of single-family uses next to industrial uses, (b) buffers should apply not only to single-family but also multifamily (the applicant confirmed the proposed buffer would also apply to multifamily uses), (c) ingress and egress to the site and requiring that access not be taken from Mulvihill Ln., and (d) the City’s lack of existing housing options in the context of the subject property currently authorizing multifamily uses and how eliminating residential entitlements negatively impacts the City’s ability to provide additional housing choices.
