Background Information:

The purpose of this request is to extend the development rights granted by the Holt Tract Planned Development District for an additional five years. The Planned Development District is set to expire in August 2021. The applicant is requesting the extension to allow additional time for the completion of the TxDOT northbound exit ramp from IH-35 to River Ridge Parkway. The applicant has stated that finding a developer for the tract while IH-35 is undergoing significant changes will be difficult.

 

The PDD was approved in July 2016 and was originally intended to facilitate commercial uses along IH-35 while taking the tract’s location within the floodplain into consideration. The PDD includes the below modifications and enhancements intended to yield higher quality development:

                     Floodplain/Environmental-Drainage analysis is required, no increase in water surface elevation is permitted, any increases in discharge due to the loss of storage within the floodplain shall be accounted for, and building are required to be elevated 2 feet or more from the floodplain.

**Note**These flood prevention standards were not in the development code at the time of this request but have since been added as code requirements.  The requirements in the PDD are functionally identical to current code requirements.

                     Impervious Cover-Restricted to 50% maximum as opposed to 80% allowed in straight zoned GC districts

                     Sidewalks-Minimum 10 ft wide sidewalk or shared use path with minimum 6 ft wide landscape and street trees strip along East River Ridge Parkway.

                     Landscaping-Identified locally invasive species prohibited.

Recommendation from the Planning and Zoning Commission meeting held March 23, 2021:
A motion was made by Commissioner Kelsey, to approve PDD-16-02(A), seconded by Commissioner Spell. The motion carried 8-0.

Alternatives:

Section 1.5.37. of the Land Development Code states that City Council will make the final determination and may take the following actions:

1.                     Reinstate the right to submit the required permit application within a time certain, subject to any conditions that may be appropriate to ensure significant progress will be made toward development of land within the PD district.

2.                     Modify the PD district regulations applicable to the property; or

3.                     Repeal the PD district for the affected portions of the property and zone the property to another zoning district classification.


Recommendation: 

Staff provides this request to the Council and recommends approval of the request to extend the development rights of the Holt Tract Planned Development District for an additional five (5) years.
