Consider approval of Ordinance 2023-25, on the second of two readings, amending the Official Zoning Map of the City in Case ZC-23-08, by rezoning approximately 1.811 acres of land out of Cottonwood Creek, Phase 3 (Unit 9, Lot 1) in Hays County, Texas, located north of the intersection of Rattler Road and Monterrey Oak, from “GC” General Commercial to “CD-4” Character District 4, or, subject to consent of the owner, another less intense zoning district classification, including procedural provisions, and providing an effective date.

Prior Council Action: At the City Council meeting held March 7, 2023, a motion was made to approve Character District-4 (CD-4), and the motion carried 6-1. The following topics were discussed: (a) removing commercial uses from the community (b) CD-4 district allowing for mixed-uses and commercial uses at street corners.

Background Information:
The subject property is a part of the Cottonwood Creek Master Plan. The existing zoning of GC allows a large variety of commercial uses and the area is shown as commercial on the existing master plan.
A change to CD-4 Zoning District will allow commercial uses while also allowing a variety of residential options as well. When the Cottonwood Creek Master Plan is renewed in 2023, this area can better reflect the future residential use, as necessary.
Council Committee, Board/Commission Action:
At their January 24, 2023 meeting, the Planning & Zoning Commission recommended approval of ZC-23-08 with an 6-1 vote, with Commissioner Spell dissenting. Commissioner Spell discussed the need to keep commercial uses that service the adjacent community.
