Prior Council Action: At their regular hearing on March 1, 2022 City Council approved the request on first reading with a 7-0 vote. Discussion topics included the requirement of a restrictive covenant to provide a 15-foot buffer between development on the subject property and the adjacent cemetery and for the developer to construct, at its expense, an 8-foot high privacy wall to further buffer the CD-3 development from the adjacent cemetery.

Background Information:
This application is associated with an annexation application scheduled for Council consideration on March 1, 2022. The developer is proposing an approximately 135 lot single-family residential development with detention pond and recreation center. A small portion of the proposed development is in the 100-year floodplain. A detention pond is proposed for this area. The proposed development will comply with all Development Code requirements.
Council Committee, Board/Commission Action:
At their February 8, 2022 meeting, the Planning and Zoning Commission recommended approval of the request with a 5-3 vote. Commissioners Meeks, Moore, and Costilla dissented and Commissioner Rand abstained.
