Prior Council Action: At their January 17th meeting Council voted to approve ZC-22-43 on first reading, with the request that the developer provide a buffer between the CD-4 and the adjacent residential development to the east in the ETJ (because the adjacent neighborhood is not zoned, Transitional Protective Yard requirements would not apply).
UPDATE: The developer has reduced the zoning boundary to provide a 9 ft Future Development “FD” buffer between the residential neighborhood and the CD-4 zoning. The FD zoning will also trigger the requirement for a Transitional Protective Yard per Section 7.2.2.2 of the Land Development Code which is the same protective yard standard that would normally be required adjacent a SF-6 (Single Family-6) zoning district.

Background Information:
The site is currently located outside of the City limits and is accompanied by a request for annexation (AN-22-19) which is being considered concurrently. The site is located within the “East Village” in the 2013 Comprehensive Plan, which is an area envisaged as an “activity node centered around the intersection of Old Bastrop and Hwy 123, East Village will boast a mix of commercial, retail, and service-oriented activity. This area will offer a variety of residential options including single family homes, duplexes, townhomes, and small multifamily projects.” In addition, the site is also within the boundaries of the proposed Second City Center in the City’s Comprehensive Plan update.
Council Committee, Board/Commission Action:
Planning and Zoning Commission voted 7-0 to recommend approval of ZC-22-43 at their regular meeting on December 13, 2022. The Commission discussed a potential buffer similar to what was approved on the east side of the existing ETJ residential neighborhood (see staff report for more information).
