Background Information:

City Staff received a request from Lower Colorado River Authority Transmission Services Corporation (“LCRA”) to amend its existing easement across a 0.58-acre tract of city parkland that is used for drainage purposes by 522 square feet.  The property is generally located in the cul-de-sac at the intersection of Quail Creek Drive and Hummingbird Lane and is undevelopable due to the drainage issues on the parcel. The purpose of LCRA’s project is to upgrade an existing electric transmission line to serve the growing areas of Hays County. The easement amendment is specifically to accommodate additional sway in the overhead lines.

LCRA is compensating the city for the amendment in the amount of $5,000.00 which staff agrees is reasonable compensation for the expanded aerial boundary for the overhead lines.

Because these actions will be taking place within dedicated parkland it is required by Section 26.002 of the Texas Parks and Wildlife Code requires that a Public Hearing be conducted.  The following requirements have been met:

1)                     Notice must be given at least 30 days before the date of the hearing

2)                     Notice must also be given to the public by publishing a notice similar to that specified in this section once a week for three consecutive weeks.  (July 3, July 10 and July 21)

3)                     The last days of publication must not be less than one week or more than two weeks before the date of the hearing. (July 21 met this requirement)

4)                     The notice must be published in a newspaper of general circulation, which paper must be published at least six days a week in the county where the land proposed to be used or taken is situated. (Notices were run in the Austin American Statesmen in the Legal Section.)
