Background Information:

1999: The business submitted an SUP for beer and wine which was approved by the Planning and Zoning Commission for one year, with conditions.

2010: An amendment to allow the sale and on-premise consumption of mixed-beverages was approved by the Planning and Zoning Commission for three years with conditions.

2013: The renewal of the mixed-beverage CUP was approved by the Planning and Zoning Commission for the lifetime of the TABC license with conditions.

2017: An amendment to allow a change in ownership was approved by staff.

2019: An amendment to expand the CUP to 390 S LBJ Dr was approved by the Planning and Zoning Commission for one year, with an effective date of September 2, 2025, with conditions.

 

Please note that Cheatham Street Warehouse, located at 119 Cheatham Street, and The Thrift Store, located at 390 S. LBJ Drive, are two separate businesses located on the same property and operating under the same TABC license.

Recommendation: 

Staff recommends approval of CUP-26-44 with the following conditions:

1.                     The permit shall be valid for three (3) years, and shall expire August 25, 2029, provided standards are met;

2.                     No outdoor amplified sound shall be permitted after the closing of the business but in no case later than 11pm all days of the week;

3.                     Outdoor background sound is permitted but should not be plainly audible at the property line after the closing of the business but in no case later than 11pm all days of the week;

4.                     The business shall be responsible for the subject property and the abutting right-of-way, excluding the public street or alley pavement, within 50 feet of any entrance and exit in a clean and sanitary condition, free from litter and refuse at all times. The maintenance responsibilities shall not overlap with another alcohol CUP Holder’s maintenance area. (LDC Section 5.1.5.5.E.2.c); 

5.                     The number of people occupying the building is required to remain compliant with the fire code, to include ensuring that occupancy loads stay at or below posted levels; and

6.                     The permit shall be posted in the same area and manner as the Certificate of Occupancy.
