Consider approval of Resolution 2021-55R, approving Change Order No. 2 in the amount of $124,320; and Change Order No. 6 in the amount of $67,182.31, for a total of $191,502.31, to the Advance Funding Agreement with the State of Texas, acting through the Texas Department of Transportation for the San Marcos River Shared Use Path Project, also known as the Cross-Town Pathway Project, that provides for construction of a multi-use bike and pedestrian trail, which change orders enable work related to the construction and installation of Americans with Disabilities Act (ADA) access ramps for river access as part of the project without increasing the City’s required funding contribution under the original agreement; authorizing the City Manager, or his designee, to execute the appropriate documents to implement the change orders; and declaring an effective date.

Background Information:
June 19, 2018, the City Council approved and Advance Funding Agreement with the State of Texas, acting through the Texas Department of Transportation (CSJ No.0914-33-078), for construction of a multi-use bike and pedestrian trail (the San Marcos River Shared Use Path) to begin east of the Hopkins Street Bridge and extend west of the Interstate Highway 35 southbound frontage road along the San Marcos River, with an estimated cost of participation by the City of $645,253.
The total project cost estimate was $2,714,326. Federal cost participation is $1,935,758, State participation (Indirect cost) is $133,315, and the local match was $645,253.
The Change Orders that Council are being asked to approve do not require any additional funds from the City, but do require Council’s approval so that TxDOT can release our already contributed funds to pay the contractor for the construction of the ADA river access ramps that were added onto the project.
We have confirmation from TxDOT that both Change Orders will be eligible for Federal participation, so the city’s responsibility would be 25% of the cost. So only $47,875.58 of our already provided participation funding will be used for these two change orders.
Change Order #2 - Is specifically related to the addition and construction of the ADA river access ramps that were installed at Rio Vista Park and at City Park in the fall of 2020 in an amount of $124,320.
Change Order #6 - When installation in City Park began to reach the point closest to the river where users would arrive on the concrete pad just below the retaining wall, it was discovered that the slope and depth of the existing pad did not meet ADA regulations. This was due to the grade being greater than what ADA regulations provide for as suitable. It was determined that removal of a portion of the existing pad and reconstructing a new one that met ADA specifications was the best way forward. The cost of the work associated with this part of the ADA ramp construction is $67,182.31.
