Prior Council Action: At the City Council meeting held August 2, 2022, a motion to approve Light Industrial (LI) zoning and to add restrictive covenants prohibiting waste related services, landfill, and junk yard uses was made and the motion carried 5-2. Following discussion on first reading, the council directed that approval of the request on second reading be subject to the recording of a restrictive covenant agreement prohibiting certain waste-related uses and activities. Other discussion topics included (a) the number of properties appearing to be within the notification area and why the notification list seemed less, (b) the difference between Smart Code zoning and Light Industrial zoning, and (c) whether the development could be achieved under the properties current zoning regulations.

Background Information:
The property was zoned SC Smart Code in 2013. Since that time, the property has remained undeveloped, and the applicant wishes to rezone to current zoning districts to entitle an industrial complex.
Council Committee, Board/Commission Action:
At their June 28, 2022 meeting, the Planning & Zoning Commission recommended approval of the request as presented with a 5-1 vote. The Commission discussed the number of properties appearing to be within the notification area and why the notification list seemed less. Upon review, staff authenticated the notification recipients finding that the ownership info of 42 lots have not yet been updated within both HCAD and the City’s GIS data. The Commission also implored staff to make City Council aware of their concern over the LI district permitting waste-related services and their desire for it to be prohibited.
