Background Information:
The Neighborhood Commission discussed the item at several meeting with comments from TAG (Tenants Advocacy Group). A resolution was approved unanimously on 02/21/2024. City Council discussed the item at the 05/07/2024 meeting and provided guidance to come back at another work session with additional information.
Texas State University Attorney for Students has dealt with this matter and has the most experience to provide a presentation. Shannon FitzPatrick will provide the presentation tonight. The presentation provides a basic understanding of the differences between Rent-By-The-Bed and Conventional leases. Shannon FitzPatrick is a 6th generation San Marcan and has been practicing law here for the past 26 years. She retired from Texas State University in 2019 after having led the Office of the Attorney for Students for 22 years. Much of the caseload of this office involved landlord/tenant relationships and the Texas Property Code which governs them.
