Background Information:
The subject property is within the larger “La Cima” neighborhood which has an approved Development Agreement adopted by City Council in 2013. A Development Agreement is a contract establishing a plan of development for land located in the City’s Extraterritorial Jurisdiction (ETJ) and may prescribe a variety of development and public facility standards and provides procedures for annexation of the property to the City. Since 2013, the Development Agreement has been amended 8 times with the last amendment occurring in May of 2026.
This zoning change request is one of three applications submitted by the applicant for this site. The other two include annexation case AN-26-03 and zoning case ZC-26-08, for Character District CD-1 (CD-1) which will be preserved as open space per the La Cima Concept Plan.
Council Committee, Board/Commission Action:
This zoning application was considered by the Planning and Zoning Commission at their September 8, 2026 meeting. A motion was made by Commissioner Costilla, seconded by Commissioner Dunn to recommend approval of the request. The motion passed with a 9-0 vote. The following topics were discussed: (a) Why La Cima must complete zoning even though a development agreement (DA) already governs development of the property. It was explained that the DA requires the property to be annexed and zoned before any development can occur. (b) The discussion also covered the maximum impervious cover allowed within La Cima. It was noted that the project’s total acreage is limited to a maximum impervious cover of 19 percent.
