Background Information:
The City of San Marcos is requesting approval of an interlocal funding agreement between the City, City of Kyle, City of Buda, and Hays County for reimbursement of funds paid to Texas Department of Public Safety (DPS) for expedited testing of seized drug evidence at its Headquarters Crime Laboratory.
This ensures faster forensic evidence processing thereby helping reduce the time individuals spend in custody while awaiting test results. For individuals unable to make bail, this is particularly impactful. Additionally, quick identification of dangerous substances such as fentanyl allows for targeted public health alerts in an effort to prevent further harm.
Hays County will receive the invoices from DPS and make timely payment for the expedited testing in the estimated annual amount of $121,182.59. Hays County will then submit invoices to the cities in October of each year for the cities’ respective pro-rata share. The City of San Marcos pro-rata share is 36%. Under no circumstance will the City be liable for any amount exceeding our pro-rata share.
The term of this interlocal agreement is October 1, 2026, through September 30, 2029.
Previously, the City relied on the Austin Police Department (APD) forensic laboratory, which has since discontinued providing these expedited services to outside agencies.
