Background Information:
On August 3, 2021, City council approved award via Resolution 2021-132R to Creative Bus Sales (Elkhart Coach) through the SmartBuy purchasing cooperative (Contract No. 556A12718) for the purchase of four buses. February 15, 2022, months after the City placed the order, staff was notified that the Elkhart Coach manufacturing plant was closing and that the City’s order could not be fulfilled.
Accordingly, the City recommends termination of the existing contract, 221-187 with Creative Bus Sales (Elkhart Coach) through the SmartBuy purchasing cooperative (Contract No. 556A12718).
The City has identified an alternate contract for procurement of the buses, via the State of Oklahoma’s interlocal cooperative purchasing agreement which is submitted as a separate agenda item this date.
