Consider approval of Resolution 2026-151R, approving an Amended and Restated Development Agreement with HK Baugh Ranch, HK Riley’s Pointe, Benchmark, and HK Real Estate Development in connection with Hays County Municipal Utility District No. 9 allowing for the use of 4,000 Living Unity Equivalent (LUEs) of wastewater and, if applicable, water service, authorized between Districts No. 8 and No. 9 to be shared and the city agreeing to serve an additional 500 LUEs of wastewater and, if applicable, water service, which may be shared between the districts; authorizing the City Manager, or her designee, to execute the agreement on behalf of the city; and declaring an effective date.

Background Information:
This proposed amendment to the Hays County Municipal Utility District No. 9 allows for the use of the 4,000 Living Unit Equivalent (LUEs) or service units authorized between Districts No. 8 and No. 9 to be shared rather than given a specific allotment. In addition, the City would agree to serve an additional 500 LUEs which can also be shared between the two districts. The City will serve the two districts located in Hays County with water and wastewater facilities.
Hays County Municipal Utility District No. 8 and No. 9 were authorized with the approved Development Agreement with HK Baugh Ranch, HK Riley’s Pointe, Benchmark, and HK Real Estate Development on December 7, 2021.
