Background Information:

The Whisper Subdivision developer allowed Maxwell SUD to serve 100 acres of residential development in the development with the agreement that the balance of the 800 acre development would be served by COSM.   The residential layout slightly exceeds the 100 acre area defined and would require the City to serve one end of one cul-de-sac with 9 lots.   This would require a main extension through easements from another street to serve these few lots while the rest of the street would be Maxwell.  

Similarly Maxwell is to serve one small tract of the airport property which will house the City of San Marcos Fire Training facility while the entire balance of the airport is served by the City. Maxwell’s system is not as capable of high flow volumes as the City system and will require expensive extension at City expense to provide additional Maxwell pipeline capacity.

This agreement will exchange these two areas to solve these respective issues after approval by the Public Utility Commission which regulates Certificates of Convenience and Necessity.
